Texas Man Sentenced to 10 Years, Carey Birmingham Pleads Guilty to Shooting Wife in Spring Home.
SPRING, Texas — A Texas man has been sentenced to 10 years in prison after pleading guilty to shooting his wife in front of their home in an incident prosecutors described as a sudden-impulse act of violence. The shooting took place in December 2021 at the couple’s Spring residence, when 60-year-old Carey Birmingham confronted his 48-year-old wife, Patricia Birmingham, after learning of her alleged infidelity.
Authorities say the confrontation escalated over roughly 30 minutes, culminating in a chilling moment captured on video. Patricia, behind the camera, recorded Carey warning her, “All right, goodbye. You’re going to meet Jesus,” before firing three shots. Their teenage daughter, Olivia, was at school during the incident.
The case proceeded to trial, where Carey Birmingham ultimately pled guilty. On March 5, 2024, an all-female jury sentenced him to 10 years in prison, imposed a $5,000 fine, and allowed for parole eligibility after approximately five years. The sentence prompted public outcry, with many criticizing what they saw as a lenient punishment for a fatal act of domestic violence. Defense attorneys argued the shooting was a momentary lapse prompted by emotional intensity.
Olivia Birmingham, reflecting on the case, rejected the characterization of the act as a crime of passion. She described losing both parents that day and emphasized that the harm inflicted on her family could not be justified by temporary anger. Patricia’s sister, Mary Dees, expressed that justice had not been fully served. Olivia also spoke about the broader context of abuse she witnessed, including emotional and financial strain, underscoring the importance of recognizing all forms of domestic abuse and the long-lasting impact on families.
